Administrative Court of Appeal confirmed legitimacy of BIONIC Hill construction

On August the 4th, 2014, Kyiv Appeal Administrative Court refused to deem illegal the decision of the Kyiv City Council on allocation of the former military territory for BIONIC Hill construction. Yet, the Court partially granted an appeal of seven residents of the former military base #136 and recognized that the land of their houses did not belong to BIONIC Hill.
“The Ministry of Defense of Ukraine and a certified company “Stolytsya Tsentrobud” are responsible for resettlement of inhabitants of the former military base #136. This company is not a party to a trial and is not related to the Park. The Court’s decision does not change anything essentially.  We did not plan to build on the site of the old buildings; they are located hundreds of meters away from the first stage facilities.  At the same time, we hope for prompt resettlement of the inhabitants. To the best of our knowledge, parties came to an understanding: 24 families out of 34 already have new renovated apartments”, - President of BIONIC Hill Innovation Park Victor Galasyuk commented on the situation.
The Court’s decision means that the second judicial authority already confirmed the development of the Innovation Park in a strict conformity with the existing legislation. Previously, on February 5th, 2014, the Kyiv District Administrative Court confirmed it.
In 2013 public hearings were held and the project was agreed with the relevant departments of the Kyiv city authorities. The company operates in a strict conformity with Ukrainian legislation system and has all the necessary documents for project realization.  In particular, Certificate of Title under the Land Transfer Act; positive decision of the state expertise on project; construction permission;  detailed plan of the territory, approved by the Kyiv City Council, the plan foreseeing construction of the scientific town as well as preserving of Belychanskyi forest nearby. Innovation Park’s territory belongs neither to Belychanskyi forest nor to any other forestry.
BIONIC Hill was one of the first in Ukraine to apply global environmental certification system of green building The Leadership in Energy and Environmental Design (LEED). The leading experts in LEED-sphere were involved: American AECOM (preliminary assessment and consulting) and ECON certifying company. The top-level international and Ukrainian architects, engineers and designers worked on the Park concept, particularly, TAM Pashenko, Hornberger+Worstell, ARUP and SWA Group. Geography of their projects covers the USA, Great Britain, France, China etc. The international experts took part in development of many significant projects in the Silicon Valley (the USA).
