On October 22nd, 2014 the Commercial Court of Kyiv invalidated the decision of the Kyiv City Council to allocate land for BIONIC Hill. Thus, the Commercial Court of Kyiv reconsidered its own decision as of September, the 23rd 2011 that rendered lawful land allocation by the Kyiv City Council.
BIONIC Hill Innovation Park enounces that in accordance with the existing Ukrainian legislation it purchased the property of a disbanded military base #136 on the secondary market and received land as a private property by the decision of the Kyiv City Council in full accordance with the Land Code.
Review of the Commercial Court’s decision of land allocation for BIONIC Hill was initiated by one of the leaders of capital factions in the Kyiv Council during the political rally. The representative of plaintiffs was a parliamentary candidate. Political activists used the trial to self-praise and to pressure the justice: they spread provocative and unreliable information on the news websites and social networks, organized public actions near the courthouse.
Such actions clearly demonstrate a political background of the process and are a pre-election PR which only harms the investment image of the country and may cause negative consequences on the economy and social sphere in Kyiv and in the country.
Given the above, BIONIC Hill Innovation Park will file an appeal on the decision of the Commercial Court of Kyiv as of October the 22nd, 2014 to the Kyiv Commercial Court of Appeal.
February 5, 2014 the Kyiv County Administrative Court confirmed legitimacy of Kyiv Council's decision to allocate the territory of the former military base for construction of BIONIC Hill Innovation Park.
August 4, 2014 Kyiv Administrative Court of Appeal delivered the same verdict.
It should be pointed out that earlier public hearings were held and BIONIC Hill project was agreed with the relevant departments of the Kyiv City government. The company operates in a strict conformity with Ukrainian legislation system and has all the necessary documents for project realization.
In particular, Certificate of Title under the Land Transfer Act; positive decision of the state expertise on project; construction permission; detailed plan of the territory, approved by the Kyiv City Council, providing construction of the scientific town as well as preserving of Belychanskyi forest nearby. Innovation Park’s territory belongs neither to Belychanskyi forest nor to any forestry.
BIONIC Hill was one of the first in Ukraine to apply global environmental certification system of green building The Leadership in Energy and Environmental Design (LEED). The leading experts in LEED-sphere were involved: American AECOM (preliminary assessment and consulting) and certifying company ECON. The top-level international and Ukrainian architects, engineers and designers worked on the Park’s concept, particularly, TAM Pashenko, Hornberger+Worstell, ARUP and SWA Group. Geography of their projects covers the USA, Great Britain, France, China etc. The international experts took part in development of many significant projects in the Silicon Valley (the USA).
